The Most Frequently Asked Questions About Florida’s Super Speeder Laws

January 19, 2026

Since Florida’s Super Speeder law took effect on July 1, 2025, law enforcement and courts across the state have been enforcing it as a criminal offense for extreme speeding rather than a simple traffic ticket. This shift has surprised many drivers and raised a ton of questions about what the law really means, what penalties apply, and what options you have if you’re charged. Below, we answer the most commonly asked questions so you understand how this law works and how it could affect you.

Recent Florida Super Speeder News

Here are some real cases showing how the law is playing out:

📌 19‑year‑olds charged in Gulf Breeze

Two 19‑year‑old men were arrested for racing and going more than 50 mph over the limit under the new Super Speeder law.

📌 Driver in Tampa recorded at 120 mph says he thought the officer was “racing him”

A driver arrested for extreme speeding claimed he misinterpreted the situation — a reminder that excuses rarely prevent charges under this strict law.

📌 Super Speeder mom arrested with infant in car

In Collier County, a driver was charged under Florida’s Super Speeder law after being observed going 101 mph with multiple children in the vehicle.

Q: Can someone driving over 100 mph (or 50 mph over the limit) really go directly to jail?

Yes. Under Florida Statute § 316.1922, dangerous excessive speeding is defined as going 50 mph over the posted limit or 100 mph or more in a way that threatens safety. This is now a criminal offense punishable by jail time.

  • First conviction: Up to 30 days in jail and/or fines.

  • Second or subsequent conviction: Up to 90 days in jail plus higher fines and potential license revocation.

Because this is a misdemeanor, law enforcement can arrest you on the spot rather than just giving a ticket.

Q: Can the officer decide to let the driver leave with a written citation? What affects that decision?

Yes, officers have some discretion. In rare cases, an officer might issue a written criminal citation instead of taking someone into custody. Factors that influence the decision may include:

  • How far above the speed limit you were going

  • Whether your driving put others at clear risk

  • Previous speeding tickets on your record

  • Your attitude during the traffic stop

That said, most drivers meeting the Super Speeder threshold are either arrested or issued a mandatory criminal citation because the statute makes court appearances compulsory.

Q: Just how many people have been arrested so far?

By October 2025, reports indicated there were about 560 arrests under the Super Speeder law statewide, including 212 arrests in August alone. However, we suspect the number could be higher.

Q: What are the penalties?

The penalties for a Super Speeder charge are serious:

  • Mandatory court appearance — you cannot just pay it online or by mail.

  • Fines and jail time — as noted above.

  • Points on your driving record — can lead to higher insurance premiums.

  • License suspension — possible on repeat convictions.

This is very different from a normal speeding ticket, which is a civil infraction.

Q: Will my license be automatically suspended after a Super Speeder arrest?

Not automatically for a first offense, but a judge can suspend or revoke your driving privileges on a second or subsequent conviction within 5 years for at least 180 days to up to 1 year.

Q: Can I drive after a Super Speeder ticket?

Yes, unless a judge orders a suspension or arrest occurs and you are held without release. Once released or if you receive a written citation, you can legally drive until a judge decides otherwise — but it’s critical to attend all court hearings.

Q: What are the long-term effects of a Super Speeder arrest?

A conviction stays on your criminal record, which can affect:

  • Employment background checks

  • Professional licenses

  • Housing applications

  • Insurance rates

Because this is a criminal misdemeanor, the impact can extend far beyond the initial fine or court date.

Q: How can a traffic lawyer help with a Super Speeder ticket/arrest?

A traffic or criminal defense attorney can:

  • Review whether the radar/lidar equipment was properly calibrated

  • Check whether proper procedures were followed during your stop

  • Argue that your speed did not meet the statute’s elements

  • Negotiate reduced charges or alternative resolutions

Experienced counsel can make a big difference.

Q: What are my chances of getting a criminal speeding charge dismissed or reduced?

Every case is different, but defenses lawyers commonly pursue include:

  • Challenging radar or laser evidence

  • Arguing the officer lacked probable cause

  • Pointing out procedural errors during the stop

  • Negotiating with prosecutors for lesser charges

It’s possible for cases to be dismissed outright, and others can be reduced with experienced legal help.

Q: What Are Your Legal Options?

If you’re charged under the Super Speeder law, you generally have three broad paths:

A. Accept the charge and plead guilty
B. Challenge the ticket based on technical issues (e.g., equipment calibration or bad procedure)
C. Negotiate reduced penalties with prosecutors

Working with a lawyer can help you evaluate which strategy gives you the best chance in court.
