The changes affect all corners of the road, and ignoring them could mean steep fines, loss of license, or time behind bars.<\/p><p data-start=\"938\" data-end=\"1031\"><strong data-start=\"938\" data-end=\"1031\">Wave One \u2014 July 1, 2025: Criminal Speeding, Teen Driver Overhaul, Move Over Law Expansion<\/strong><\/p><p data-start=\"1033\" data-end=\"1246\">This first wave began mid-year with legislation focused on reducing fatal crashes and curbing aggressive driving. HB 351 passed with bipartisan support and took effect July 1, ushering in several landmark changes.<\/p><p data-start=\"1033\" data-end=\"1246\"><a href=\"https:\/\/www.theticketclinic.com\/es\/blog\/school-zone-speed-camera-programs-in-fl\/\">Check out our map tracking speed camera activations around the state.<\/a><\/p><p data-start=\"1248\" data-end=\"1292\"><strong data-start=\"1248\" data-end=\"1292\">Super Speeder Law \u2014 Now a Criminal Offense<\/strong><\/p><p data-start=\"1294\" data-end=\"1418\">Under section 316.1926 of the Florida Statutes, Florida now classifies certain extreme speeding violations as criminal acts.<\/p><p data-start=\"1420\" data-end=\"1517\">Before this law, even driving over 100 miles per hour was often treated as a civil citation. Now?<\/p><ul data-start=\"1519\" data-end=\"1970\"><li data-start=\"1519\" data-end=\"1641\"><p data-start=\"1521\" data-end=\"1641\">Driving 50 mph or more above the posted limit or any speed over 100 mph automatically becomes a criminal traffic offense<\/p><\/li><li data-start=\"1642\" data-end=\"1789\"><p data-start=\"1644\" data-end=\"1789\">First-time offenders face a mandatory court appearance, up to 30 days in jail under section 775.082, and fines reaching $500 under section 318.18<\/p><\/li><li data-start=\"1790\" data-end=\"1970\"><p data-start=\"1792\" data-end=\"1970\">Second or subsequent violations within 5 years elevate the charge. Offenders face up to 90 days in jail and fines up to $1000, plus driver license suspension under section 322.27<\/p><\/li><\/ul><p data-start=\"1972\" data-end=\"2140\">The law essentially draws a legal line between speeding and reckless disregard for life, making it easier for officers to press criminal charges without proving intent.<\/p><p data-start=\"2142\" data-end=\"2174\"><strong data-start=\"2142\" data-end=\"2174\">Teen Licensing Gets Stricter<\/strong><\/p><p data-start=\"2176\" data-end=\"2308\">Prior to July 1, teens only needed to complete a four-hour Traffic Law and Substance Abuse Education course and pass a written test.<\/p><p data-start=\"2310\" data-end=\"2347\">Now, Florida Statute 322.56 requires:<\/p><ul data-start=\"2349\" data-end=\"2593\"><li data-start=\"2349\" data-end=\"2459\"><p data-start=\"2351\" data-end=\"2459\">Completion of a full driver education course approved by the Department of Highway Safety and Motor Vehicles<\/p><\/li><li data-start=\"2460\" data-end=\"2512\"><p data-start=\"2462\" data-end=\"2512\">Vision and hearing exams administered by the state<\/p><\/li><li data-start=\"2513\" data-end=\"2545\"><p data-start=\"2515\" data-end=\"2545\">A signed parental consent form<\/p><\/li><li data-start=\"2546\" data-end=\"2593\"><p data-start=\"2548\" data-end=\"2593\">A passing score on the Class E knowledge exam<\/p><\/li><\/ul><p data-start=\"2595\" data-end=\"2732\">This change intends to reduce crash rates among teen drivers, who statistically are at higher risk during the first year of solo driving.<\/p><p data-start=\"2734\" data-end=\"2771\"><strong data-start=\"2734\" data-end=\"2771\">Move Over Law \u2014 A Much Bigger Net<\/strong><\/p><p data-start=\"2773\" data-end=\"2991\">Florida\u2019s &#8220;Move Over&#8221; statute, section 316.126, was once limited to emergency vehicles, tow trucks, and sanitation trucks. Now it applies to <em data-start=\"2914\" data-end=\"2919\">any<\/em> vehicle displaying hazard lights or warning signals along the roadside.<\/p><p data-start=\"2993\" data-end=\"3040\">Under the new version of the law, drivers must:<\/p><ul data-start=\"3042\" data-end=\"3192\"><li data-start=\"3042\" data-end=\"3076\"><p data-start=\"3044\" data-end=\"3076\">Move over one lane when possible<\/p><\/li><li data-start=\"3077\" data-end=\"3192\"><p data-start=\"3079\" data-end=\"3192\">If unable to move over safely, slow to 20 mph under the posted limit or to 5 mph when the limit is 20 mph or less<\/p><\/li><\/ul><p data-start=\"3194\" data-end=\"3340\">Violators face a fine, points on their license, and heightened insurance premiums. Officers have ramped up ticketing in major metro areas already.<\/p><p data-start=\"3342\" data-end=\"3435\"><strong data-start=\"3342\" data-end=\"3435\">Wave Two \u2014 October 1, 2025: DUI Refusal Charges, Enhanced Felonies, Automated Enforcement<\/strong><\/p><p data-start=\"3437\" data-end=\"3710\">The second wave of 2025 reforms came into force October 1 and shifted the legal framework of DUI enforcement and vehicle-related homicide cases. These changes focus on holding repeat and high-risk drivers accountable with new charging powers and expanded criminal exposure.<\/p><p data-start=\"3712\" data-end=\"3762\"><strong data-start=\"3712\" data-end=\"3762\">Refusing a Breath or Blood Test Is Now a Crime<\/strong><\/p><p data-start=\"3764\" data-end=\"3975\">Trenton\u2019s Law, named after a child killed by an impaired driver, transformed Florida Statute 316.1939. Previously, refusing a chemical DUI test resulted in a one-year license suspension under administrative law.<\/p><p data-start=\"3977\" data-end=\"4029\">Now, refusal is its own standalone criminal offense:<\/p><ul data-start=\"4031\" data-end=\"4305\"><li data-start=\"4031\" data-end=\"4164\"><p data-start=\"4033\" data-end=\"4164\">First refusal is a second-degree misdemeanor under Florida Statute 316.1939(1), punishable by up to 60 days in jail and a $500 fine<\/p><\/li><li data-start=\"4165\" data-end=\"4305\"><p data-start=\"4167\" data-end=\"4305\">Second or subsequent refusals are now first-degree misdemeanors under 316.1939(2), with penalties reaching 1 year in jail and a $1000 fine<\/p><\/li><\/ul><p data-start=\"4307\" data-end=\"4439\">Most notably, prosecutors do not need to prove that the person was impaired. Simply refusing the test is sufficient for prosecution.<\/p><p data-start=\"4441\" data-end=\"4494\"><strong data-start=\"4441\" data-end=\"4494\">DUI Manslaughter \u2014 Repeat Offenders Face 30 Years<\/strong><\/p><p data-start=\"4496\" data-end=\"4650\">Another major update was made to section 782.071 and section 316.193(3). It targets individuals with prior DUI or BUI convictions who cause a fatal crash.<\/p><p data-start=\"4652\" data-end=\"4721\">If someone previously convicted of DUI causes a death in a new crash:<\/p><ul data-start=\"4723\" data-end=\"4932\"><li data-start=\"4723\" data-end=\"4790\"><p data-start=\"4725\" data-end=\"4790\">The charge becomes a first-degree felony instead of second-degree<\/p><\/li><li data-start=\"4791\" data-end=\"4855\"><p data-start=\"4793\" data-end=\"4855\">Sentence exposure jumps from 15 years to a maximum of 30 years<\/p><\/li><li data-start=\"4856\" data-end=\"4932\"><p data-start=\"4858\" data-end=\"4932\">Judges now have more flexibility to deny bond and issue harsher sentencing<\/p><\/li><\/ul><p data-start=\"4934\" data-end=\"5073\">This is a powerful shift that allows the court to treat repeated recklessness as intentional criminal behavior, especially in deadly cases.<\/p><p data-start=\"5075\" data-end=\"5114\"><strong data-start=\"5075\" data-end=\"5114\">School Zone Speed Cameras Statewide<\/strong><\/p><p data-start=\"5116\" data-end=\"5231\">Section 316.0776 authorizes the installation of automated speed enforcement systems in school zones. These systems:<\/p><ul data-start=\"5233\" data-end=\"5401\"><li data-start=\"5233\" data-end=\"5271\"><p data-start=\"5235\" data-end=\"5271\">Use radar (or lidar) to detect speed violations<\/p><\/li><li data-start=\"5272\" data-end=\"5328\"><p data-start=\"5274\" data-end=\"5328\">Capture license plate data and issue citations by mail<\/p><\/li><li data-start=\"5329\" data-end=\"5401\"><p data-start=\"5331\" data-end=\"5401\">Activate only during designated school hours and flashing beacon times<\/p><\/li><\/ul><p data-start=\"5403\" data-end=\"5557\">Tickets issued through these systems carry no points but must still be paid or contested in court. Fines vary by jurisdiction but typically start at $100.<\/p><p data-start=\"5559\" data-end=\"5719\">Though less severe than criminal charges, these tickets are designed to build habits and increase school zone compliance using quiet but persistent enforcement.<\/p><p data-start=\"5721\" data-end=\"5756\"><strong data-start=\"5721\" data-end=\"5756\">Other Quiet but Serious Changes<\/strong><\/p><p data-start=\"5758\" data-end=\"5859\">Several additional reforms have come into play that drivers may not even notice until they are cited.<\/p><p data-start=\"5861\" data-end=\"5907\"><strong data-start=\"5861\" data-end=\"5907\">License Plate Obstruction Laws Now Tighter<\/strong><\/p><p data-start=\"5909\" data-end=\"5947\">Florida Statute 316.605 now prohibits:<\/p><ul data-start=\"5949\" data-end=\"6089\"><li data-start=\"5949\" data-end=\"5970\"><p data-start=\"5951\" data-end=\"5970\">Tinted plate covers<\/p><\/li><li data-start=\"5971\" data-end=\"5999\"><p data-start=\"5973\" data-end=\"5999\">Flipped or rotating plates<\/p><\/li><li data-start=\"6000\" data-end=\"6089\"><p data-start=\"6002\" data-end=\"6089\">Frames or devices that obscure any part of the plate, including toll evasion mechanisms<\/p><\/li><\/ul><p data-start=\"6091\" data-end=\"6279\">Drivers caught using any modification intended to defeat toll cameras or law enforcement readers face civil penalties, and in some cases, misdemeanor charges for intent to evade detection.<\/p><p data-start=\"6281\" data-end=\"6317\"><strong data-start=\"6281\" data-end=\"6317\">Restitution in Hit and Run Cases<\/strong><\/p><p data-start=\"6319\" data-end=\"6503\">Under updates to Florida Statute 316.027, drivers who flee the scene of a crash involving injury can now be ordered to pay restitution regardless of criminal conviction.
