The law increases penalties for impaired driving, makes a first refusal to test a criminal offense, and enhances punishments for multiple DUI\u2011related fatalities.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-breath-urine-test-refusals-become-criminal\" class=\"wp-block-heading\">Breath \/ Urine Test Refusals Become Criminal<\/h3>\n<p><!-- \/wp:heading --><!-- wp:paragraph --><\/p>\n<p>Under the prior regime, refusing a chemical test (breath, urine, or blood) during a DUI stop was treated as an administrative or civil infraction on a first refusal, and elevated only on subsequent refusals. Trenton\u2019s Law changes that:<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:list --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\"><!-- wp:list-item --><\/ul>\n<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>UNA <strong>first refusal<\/strong> to submit to a lawful breath or urine test will now be a <strong>second\u2011degree misdemeanor<\/strong> (which can include jail time, fines, and a criminal record).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>UNA <strong>second or subsequent refusal<\/strong> is elevated to a <strong>first\u2011degree misdemeanor<\/strong> with harsher punishments.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>Courts must advise the arrested person of the criminal consequences of refusal under the new law.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><!-- \/wp:list --><!-- wp:paragraph --><\/p>\n<p>This shift means that even first-time DUI suspects now risk criminal charges simply by refusing to blow.<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-harsher-sentences-for-repeat-dui-manslaughter-vehicular-vessel-homicide\" class=\"wp-block-heading\">Harsher Sentences for Repeat DUI Manslaughter \/ Vehicular \/ Vessel Homicide<\/h3>\n<p><!-- \/wp:heading --><!-- wp:paragraph --><\/p>\n<p>One of the most dramatic parts of Trenton\u2019s Law is the escalation of penalties when a driver (or boater) with prior DUI\/BUI or vehicular homicide convictions causes death:<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:list --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\"><!-- wp:list-item --><\/ul>\n<\/li>\n<\/ul>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>UNA <strong>second or subsequent conviction<\/strong> for DUI or BUI manslaughter, or vehicular homicide or vessel homicide, is now classified as a <strong>first\u2011degree felony<\/strong> (rather than second degree) with a <strong>maximum sentence of 30 years<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>Previously, repeat manslaughter or homicide charges under DUI would be capped at 15 years (second\u2011degree felony).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>The law also demands these offenses be ranked more severely under Florida\u2019s Criminal Punishment Code offense severity chart.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><\/p>\n<p><!-- \/wp:list --><!-- wp:paragraph --><\/p>\n<p>Because of these increases, Florida courts will treat repeat DUI fatalities with far more severity.<\/p>\n<p>\u00a0<\/p>\n<p><!-- \/wp:paragraph --><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-boating-under-the-influence-bui-vessel-homicide-effects\" class=\"wp-block-heading\">Boating Under the Influence (BUI) \/ Vessel Homicide Effects<\/h3>\n<p><!-- \/wp:heading --><!-- wp:paragraph --><\/p>\n<p>Trenton\u2019s Law doesn\u2019t only target cars. It extends into <strong>boating under the influence (BUI)<\/strong> <a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=81302&amp;\">statutes:<\/a><\/p>\n<p><!-- \/wp:paragraph --><!-- wp:list --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\"><!-- wp:list-item --><\/ul>\n<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>A prior BUI or DUI conviction can now aggravate a boating manslaughter case into a first\u2011degree felony under the new repeat\u2011offender scheme.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>The same 30\u2011year maximum penalty can apply to vessel homicide or boating manslaughter under repeat offender conditions.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><!-- \/wp:list-item --><!-- wp:list-item --><\/p>\n<ul class=\"wp-block-list\">\n<li style=\"list-style-type: none;\">\n<ul class=\"wp-block-list\">\n<li>Any refusal to submit to a chemical test during a boating stop (if treated under DUI procedures) could likewise incur criminal penalties under the new rules.
